Content Trading Sites Have Been Shut Down

For 18 months prior to June 10th 2009 the sites known as WP-Board.com, WP-Board.net, WorldPlagiates.com and BigMouthShirts.net had been operating as illegal file sharing and trading websites - in clear violation of both Criminal and Civil Copyright laws.
They are now closed and I, James S. Grady of Littleton, Colorado. USA. have control of the domain names, as well as all logs and records. They will not be returning as illegal file trading forums / boards / sites. The former proprietors, members and financial supporters all violated the Copright Laws of the United States and are likely to be sued.
Over the last 18 months these sites, the administrators of them, the file contributing visitors and the financial supporters, have done great damage to myself and many, many other small business persons world wide. The illegal posting of our content has caused many sites to close, revenues to drop as much as 60%, and people to be laid off.
One popular model recently had to drop out of college because the revenue she counted on for the last three years suddenly dropped when "TomTom" and "Platoon" (WP Admins and partners) made her a premium model and started giving all her content away - not just a few pictures, but all of the content of her site.
An entire section of the forum was dedicated solely to my work. It took me years to get any good at the pretty girl pictures business, and monthly it takes tens of thousands of dollars to maintain my sites and continue to produce successful, highly marketable content. The idea of these people stealing from me day after day was a huge thorn in my side. My mean side wanted to just drive over to "Platoon's" house and beat his punk ass with a baseball bat.
The entire situation disgusted me and I decided to see what could be done through proper legal channels. It was a time consuming and expensive pursuit, but well worth it. Over the next few weeks - when I have a few minutes between lawyer meetings and lawsuit preparation - I'll be posting a series of short stories or blog entries here laying it all out, step by step.
Step 1 - Identification and Evidence Collection
Starting the process was easy. It was to identify who was running the site - meaning who my target would be. "Platoon" is a 38 year old male in a suburb of Dayton, Ohio. He is married and has a child in 6th grade. He filed for bankruptcy in 1999 and is on shaky financial ground here ten years later.
I hired a private investigator (former FBI agent) in Dayton to follow him and dig into his operation. This included going into his trash that was placed on public property in the alley behind his house and business. That was a goldmine of information, including printed receipts showing the full name and address of persons that donated to the WP-Board operation to help pay server and other expenses.
He went so far as to use a variety of fake return addresses for t-shirt shipping, but it wasn't enough to keep the skilled investigator from tracking him down.
The investigator, and others working with me online, simply located and organized a pile of rock solid evidence of copyright infringement (direct, contributory and vicarious) and many other actions that would take mister "Platoon" and his illegal file trading friends into court for years to come. That would include a possible prison sentence such as Daniel Dove (click here for info)
I am not using "Platoon's" real name in this outline. I agreed to that as part of a fast settlement discussed in Step 2.
Step 2 - Preparing to Sue or Settle.
The next step was to plan the legal attack. This is where I'm very experienced. This is also where I have great lawyer back-up and I'll be ready to file in Federal Court if we can't settle with most of the violators first.
A Federal Lawsuit was prepared claiming copyright infringement and unfair competition. The suit was not filed, just prepared. On the evening of June 9th I flew 1220 miles from my home in Colorado to Dayton, Ohio so I could personally confront "Platoon". The private investigator met me at "Platoon's" shop the afternoon of June 10th. There was no threats or physical contact except the normal introductory handshake.
In addition to the lawsuit I had with me a few copies of the 125 pieces of solid evidence we had compiled. I also had a 7 page cover letter from me to him (without lawyers involved) explaining who I was, what I knew, and what it would be like to be tied up in Federal Court as a struggling businessman with a small child. It also contained a proposed pre-trial settlement. The idea of me getting ownership of the domain names was not in that letter.
I was in his shop about 5 minutes and asked him to let me know by phone within two hours if he wished to accept the settlement offer or if I should have my people file the suit later that afternoon.
He called before the two-hour deadline passed and agreed to all my terms. He mentioned in that call he was leaving the entire file trading and sharing scene rather than face other angry webmasters like myself. At that time I offered a reasonable amount in cash for the domain names and sites. He accepted.
The more formal settlement gave me all logs, records, files, back-ups and other materials related to the WP forums. It also gave me access to the server by FTP to retrieve other potential evidence, as well as to the admin control panel of the forum software. It's all mine, as part of the purchase.
"Platoon's" real name will not be used here. In truth he seems to be a pretty good guy - hard working at his own shop building important items needed by our military. He seems to have been led astray by the other admin known as "TomTom" who hides in Germany and gets other people to put servers, t-shirt sites and other items in their own names.
Step 3 - Hanging a Pirate
In 1719 the Pirate Blackbeard (Edward Thatch / Teach) was decapitated in a battle with the determined men working with English pirate hunter Lieutenant Robert Maynard. When Maynard, and the crew of his ship "The Adventure", returned to Hampton Roads they had Blackbeard's head still hanging from the bowsprit as a warning to others. Upon docking Maynard presented Blackbeard's head to Governor Spotswood, who had it suspended from a tall pole on the west side of the Hampton River at a place now known as Blackbeard's Point, as a ghoulish admonition to would-be pirates.
That is my plan in the case of WP posters of my content. I'm going to hang a few out for the rest to see.
With TomTom hiding in his little German rat-hole, and others foolishly following his every word and acting all tough behind the fake screenames, I know that the illegal posting and sharing of my content will not soon be stopped. I've decided to "Discourage by Example". I'm going to actively pursue in the Federal Court at least 5, and more likely 8-10, of the biggest posters of my content.
The logs, files, IP addresses and other things collected in the last 60 days make it so darn rock solid that a beginning lawyer fresh out of law school could win each case.
First I'll send a "Cease & Desist" letter as required by the local rules of most Federal Courts. That letter is formal lawyer sounding information and offers a settlement. Some take it, some ignore it, and some in the past have even been dumb enough to try and fight and go into court saying they have a right to do what they want with my works. I've never lost a copyright suit.
I do the most basic work of C & D letters myself. If we actually have to file against any of these foolish people it will be handled by the lawyers that have been helping all along.
What is Next?
For now I have a successful business to run and enjoy. I'll be finishing other C & D letters and posting here as they are completed over the next several days. As I said - I don't just create them, I have to be exact and double check everything to make sure it can be proven in a court should the need arise.

I shortened this page today as I prepare for an all new site dedicated to exposing the true names and contact information of file sharing thieves (also known as pirates). Those interested in the old page can find it here.

For now - I have been forced by various pirates (thieves) to start filing lawsuits. Writing them letters, having lawyers write letters, calling them and asking them to stop - none of that works with these thieves.

Grady VS. Todd Bremer
This guy was posting several of my images on a couple of trading boards. He was using Megaupload (recently charged by the FBI with commercial copyright infringement) to distribute my photos. I sued in the fall of 2011, he got scared and failed to show up in court. While failing to show in court he was acting all tough over on the boards (why these guys are called "keyboard tough guys" - only tough when typing from home, never in person or a court). On February 2, 2012 in the Federal Case 11-CV-02586 Chief United States District Judge Wiley Y. Daniel awarded me a $540,000.00 judgement - $30,000.00 each for 18 photographs that Defendant Bremer posted to the sites Motherless and DarkJB. With the Chief Judge having set that precedent we would expect no less than $30,000.00 for each of the direct infringements others have committed.
Grady VS. William Swisher
This case is almost exactly like the one above. The guy was posting my images on trading boards and using Megaupload (much like the site Oron.com which is now in major trouble and turning records over to lawyers and Federal authorities). He acted all tough online and by email - even going so far as making demands of me. Of course, once served with the lawsuit he shut his mouth and never showed up in court. This is Federal Case 11-CV-02880 and a judgement was entered in my favor on February 14th, 2012. Chief United States District Judge Wiley Y. Daniel referred the matter to a magistrate to determine the award amount. Based on the precendent the Chief Judge set in the Todd Bremer case the award could be over 20 million, but thats silly and my legal guys requested just $2,244,250.00 - which this loser pirate / thief will never be able to pay, but should set a good example. The amount should be announced next month and I'll garnish his wages for 20 years.
Grady VS. Robin Fielder
Crazy case of a guy that works for The Subway Group-Subway Development Corp in Oregon and was calling himself ArrogantDirtBag (name fits) and DirtyDevilPorn online. True loser piece of crap. Steals, cheats on his wife, makes up fake online profiles to send sexy messages to co-workers right across the office (when the gals think he is some cool dude across town), and even after being sued he kept joining pirate sites and putting his family at risk. Married, one kid and another on the way and still out there pirating. I sued (Federal case 12-CV-00039) and like the pussy he is - he ran to Bankruptcy Court thinking that would prevent him from losing the case or owing me anything. It didn't work - because it says right in the Bankruptcy Code that you can't do it. Section 523(a)(6) of the Code limits discharge for debt incurred "for willful and malicious injury by the debtor to another entity or to the property of another entity." Simply stated, Section 523(a)(6) attempts to incorporate intentional tort principles into bankruptcy law, thereby preventing discharge of any debts the petitioner incurred as a result of their intentional wrongdoings. The only way to use Bankruptcy to get out of a Copyright lawsuit it to convince the Federal Judge in Bankruptcy Court that the bad guy did it "unintentionally". Thats funny - this guy posted over 4000 photos to 2 different sites, then linked them to a 3rd site. The bankruptcy Court didn't fall for his crap and there is a hearing set for October to determine how much he owes me. The range is between 3 and 11 million dollars. Once that is determined I'll be able to garnish his wages for 20 years and he'll never be able to own anything like a house or decent car or have good credit.
Grady VS. Carl Samuelson
Same shit, different loser. Guy was Application Services Manager for Kenosha County, Wisconsin until they found out he was sued for copyright infringement (and there was a good chance he was doing it from his office). He is another classic loser and fake tough guy. He even called himself "MI6Agent" in some online forums. He tried to defend himself in court, filed one document, but then didn't show in court twice and the Magistrate has now given him just one more chance. Doesn't matter - even if the thief shows up he can't win the case. He'll owe me between $920,000.00 and $3,680,000.00, depending upon if the Judge finds that the violating was "willful" (which it always is when they post to pirate forums and places like Megaupload and Oron).
Grady VS. Other Losers
We have 17 suits prepared but the lawyer insisted that we send pre-litigation letters to several guys first. That would include: Greg Strong (long time loser and fake businessman), Kyle Godette, Rodney Wahlstrom, Al Rapsys, Andrew Beck, Benjamin Rojek, Benjamin Sonnett, Garret Smith, Joe Vinson, John Cavender, Larry Skillin, Michael Varner, Mitchell Turner, Pete Nelson, Tim Barton and others.

I couldn't resit popping in here to tell the quick story of "bob", whom I will now call "Bob the Pussy". Its simple - almost daily somebody uses the form below to send me some sort of short rude message. Every single person that does that uses a fake email address. I can only assume they are scared of something and don't really want to debate the issues. Sort of like the 2nd grade boy that calls the neighbor girl ugly as he is running in his parent's house and locking the door. Thinks that he did something brave but ran away scared and hides in mommy's arms.
Anyway, today I got an email from that form from "bob". He made several points and I thought he was looking for a reply so I quickly typed one up and sent it. Unfortunately, "bob" turned out to be a pussy like the rest - the email address he gave was fake. Meaning, like that 2nd grader, he said something and ran away to be forever known as "Bob the Pussy".

Assuming you used an email that allows for debate (most pussies don't use an email I can reply to), my quick reply is...
1- The case mentioned was in open court before the chief judge - who took testimony and reviewed records, etc.
2- Being an ex-con means nothing. That was a 1982 case - 30 years ago. Has zero to do with copyright law, etc.
3- You are welcome to contact anybody you like and tell them too appeal. If they don't show up for court in the first place they lose all right to appeal any of the rulings that came down in the court hearings they skipped.
4- You are welcome to send me links to the cases showing damages being "discharged in court if a heightened sense of malice isn't present." I haven't seen such a case but would surely be interested.
5- You are welcome to tell all those folks my name and address as shown below. If they wish to sue for "slander and defamation of character."
When I file cases (there are about 15 active now nationwide, and another batch on my desk) it is in the hope of facing these people in court. If they wish to try and do it now they are welcome - I have always been willing to state my side in a courtroom.
